TERMS AND CONDITIONS - EQUATOR EXPEDITIONS

Welcome to Equator Expeditions. By using our services to book tours, activities, or any other service offered, you agree to the following terms and conditions. Please read carefully the details below:

1. Definitions

The following terms have the meaning indicated below in these Terms and Conditions:

Client: The person or entity who makes a booking with Equator Expeditions to participate in a tourist service.
Equator Expeditions: The tour operator offering and selling tourist services, either directly or through an intermediary.
Service: The tourist products and experiences detailed in the Equator Expeditions offer, which include, but are not limited to: transportation, accommodation, guided activities, and any other component related to the contracted travel package.

2. Bookings

Booking Process: Bookings must be made through the official Equator Expeditions website, by phone, or by email (info@equator-expeditions.com). To confirm the booking, the Client must provide the required information and complete the payment as per the established terms. For tours to Galápagos or those requiring flight tickets, a traveler data form and passport information must be completed.

Booking Confirmation: Once the booking is made and payment is processed, the Client will receive a confirmation email with the details of the reservation. Failure to make payment within the agreed time or incomplete information may invalidate the booking.

Special Requirements: The Client must inform Equator Expeditions of any special needs (dietary restrictions, accessibility, etc.) at the time of booking.

3. Payments and Prices

Prices: The prices of services will be detailed when offering travel packages, based on availability and seasons. Prices include all applicable taxes (as applicable), but may change due to variations in operational costs. Equator Expeditions reserves the right to modify the price of a tour without prior notice if there are increases in costs beyond its control, such as fuel surcharges on cruise itineraries, changes in government taxes, or variations in flight prices reserved with the operator.

Payment Methods: The Client can pay by credit card, bank transfer, or other methods previously agreed with Equator Expeditions.

Payment Policy: Full payment is required to confirm the booking. An initial deposit is requested, and the remaining balance must be paid 60 days before the service begins.

If the booking is made more than 90 days in advance, an initial payment of 30% is requested, and the remaining 70% is due as agreed with the sales agent.

If the booking is made less than 60 days in advance, full payment is required within one week of booking confirmation.

4. Client and Equator Expeditions' Responsibilities

Equator Expeditions' Responsibility: Equator Expeditions is committed to providing services according to quality and safety standards. It is not responsible for circumstances beyond its control, such as extreme weather conditions, transportation failures, or unforeseen itinerary changes due to factors beyond its reach. It is also not responsible for injuries, illnesses, deaths, or any damage caused by the Client under any circumstances.

Client's Responsibility: The Client is responsible for following the instructions of the guides and Equator Expeditions' staff during the activities. The Client must also provide accurate information about their needs and physical conditions. The Client assumes responsibility for their behavior and any damage they may cause to third parties or property during the activity.

5. Changes and Cancellations

Client’s Changes: If the Client needs to modify a booking, they must contact Equator Expeditions as soon as possible. Changes will be subject to availability and the terms of the activity, which could involve additional charges.

Client’s Cancellations: In case of cancellation, Equator Expeditions will apply the following policies:

Cancellation more than 60 days in advance: A 30% penalty of the total value of the contracted services as a cancellation fee.
Cancellation less than 60 days before the service: A 100% penalty of the total value of the contracted services as a cancellation fee.

Cancellations by Equator Expeditions due to Force Majeure: Equator Expeditions reserves the right to cancel or modify a service due to unforeseen circumstances (weather conditions, natural incidents, local circumstances, security, force majeure, etc.). Changes may include modification of hotels, flight schedules, routes, transportation, itineraries, among others.

6. Complaints or Claims

If the Client has any complaints, they must communicate it immediately to their account agent at Equator Expeditions during the activity. If not resolved at that moment, the Client may send a complaint via email to info@equator-expeditions.com or through the contact form on the website. Equator Expeditions is committed to reviewing all complaints and providing a response within a reasonable time.

7. Privacy

Equator Expeditions is committed to protecting the privacy of the Client’s personal data. The information provided will be used exclusively to manage the booking and associated services. We will not share personal information with third parties without the Client's prior consent, unless necessary for the execution of the contracted services.

8. Travel Insurance

It is mandatory for all travelers to have adequate travel insurance before confirming their booking. This insurance must cover risks such as medical emergencies, cancellations, lost luggage, repatriation, among others. Equator Expeditions reserves the right not to process the booking if valid insurance proof is not provided.
