TERMS AND CONDITIONS – EQUATOR EXPEDITIONS

Welcome to Equator Expeditions. By using our services to book tours, activities, or any other offered service, you agree to the following terms and conditions. Please read the information below carefully:

Definitions

The following terms have the meanings indicated below in these Terms and Conditions:

  • Client: The person or entity making a booking with Equator Expeditions to participate in a tour service.

  • Equator Expeditions: The tour operator offering and selling tourist services, either directly or through an intermediary.

  • Service: The tourist products and experiences detailed in Equator Expeditions’ offer, including but not limited to: transportation, accommodation, guided activities, and any other component related to the contracted travel package.

Bookings

  • Booking Process: Bookings must be made through the official Equator Expeditions website, by phone, or via email (info@equator-expeditions.com). To confirm the booking, the client must provide the required information and complete the payment according to the established terms. For trips to the Galapagos or those requiring airline tickets, a traveler information form must be completed and passport details provided.

  • Booking Confirmation: Once the booking is made and the payment is processed, the client will receive a confirmation email containing the details. Non-payment within the agreed timeframe or incomplete information may invalidate the reservation.

  • Special Requirements: The client must inform Equator Expeditions of any special needs (dietary restrictions, accessibility, etc.) at the time of booking.

Payments and Pricing

  • Prices: Service prices will be detailed when offering travel packages, based on availability and season. Prices include all applicable taxes (where applicable), but may vary due to changes in operational costs. Equator Expeditions reserves the right to modify the price of a tour without prior notice if cost increases occur beyond its control, such as fuel surcharges on cruise itineraries, changes in government taxes, or price variations for flights booked through the operator.

  • Payment Methods: The client may pay by credit card, bank transfer, or other methods previously agreed upon with Equator Expeditions.

  • Payment Policy: Full payment is required to confirm the booking. An initial deposit is required, and the remaining balance must be paid 60 days before the start of the service.

    • If the booking is made more than 90 days in advance, an initial payment of 30% is required, with the remaining 70% to be paid as agreed with the sales agent.

    • If the booking is made less than 60 days in advance, full payment is required within one week of booking confirmation.

Responsibilities of the Client and Equator Expeditions

  • Equator Expeditions’ Responsibility: Equator Expeditions undertakes to provide services in accordance with quality and safety standards. It is not responsible for circumstances beyond its control, such as extreme weather conditions, transport failures, or unforeseen itinerary changes due to factors outside its scope. Nor is it responsible for injury, illness, death, or damage caused by the Client under any circumstances.

  • Client’s Responsibility: The Client is responsible for following the instructions of the guides and Equator Expeditions staff during activities. Likewise, they must provide accurate information regarding their needs and physical condition. The Client assumes responsibility for their behavior and any damage they may cause to third parties or their property during the activity.

Changes and Cancellations

  • Changes by the Client: If the client needs to modify a booking, they must contact Equator Expeditions as soon as possible. Changes will be subject to availability and the conditions of the activity, which may incur additional charges.

  • Cancellations by the Client: In the event of a cancellation, Equator Expeditions will apply the following policies:

    • Cancellation more than 60 days in advance: A penalty of 30% of the total value of the contracted services will apply as cancellation fees.

    • Cancellation less than 60 days prior to service provision: A penalty of 100% of the total value of the contracted services will apply as cancellation fees.

  • Cancellations due to Force Majeure by Equator Expeditions: Equator Expeditions reserves the right to cancel or modify a service due to unforeseen circumstances (weather conditions, natural disasters, local circumstances, safety concerns, force majeure, etc.). Changes may include modifications to hotels, flight schedules, routes, transportation, and itineraries, among others.

Complaints or Claims

If the Client has any complaint, they must immediately inform their account agent at Equator Expeditions during the activity. If it is not resolved at that time, the Client may send a complaint by email to info@equator-expeditions.com or via the contact form on the website. Equator Expeditions undertakes to review all complaints and provide a response within a reasonable timeframe.

Privacy

Equator Expeditions is committed to protecting the privacy of the Client’s personal data. The information provided will be used exclusively to manage the booking and associated services. We will not share personal information with third parties without the Client’s prior consent, unless necessary for the execution of the contracted services.

Travel Insurance

It is mandatory for all travelers to have adequate travel insurance prior to confirming their booking. This insurance must cover risks such as medical emergencies, cancellations, lost luggage, and repatriation, among others. Equator Expeditions reserves the right not to process the booking if valid proof of insurance is not presented.
